Product liability is a theory of liability that allows a person to recover for damages they suffer as the result of a defective product from the manufacturer or, in certain cases, the seller of that product. In Louisiana manufacturers may be held liable for products that are unreasonably dangerous in one of four ways: (1) the product is unreasonably dangerous in its composition; (2) the product is unreasonably dangerous in its design; (3) the product is unreasonably dangerous because the manufacture fails to provide a proper and sufficient warning; or (4) the product is unreasonably dangerous because the product does not conform with an express warranty made by the manufacturer.
